Terms of Service
These Terms of Service ("Terms") govern your use of the StakeMarker mobile application and related services (the "App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
Use of the App
StakeMarker grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, recreational, or internal golf scoring and accounting purposes.
You agree not to misuse, disrupt, copy, reverse engineer, modify, or unlawfully use the App or related infrastructure.
All rights not expressly granted are reserved by StakeMarker.
User Data
You are responsible for the accuracy of scores, handicaps, accounting information, and other data entered into the App.
You retain ownership of your submitted content, but grant StakeMarker a non-exclusive, worldwide, royalty-free license to host, store, process, and display such content solely to operate and improve the App.
Phone Number Verification (Optional)
StakeMarker may offer an optional sign-in flow that verifies your identity using your mobile phone number (sometimes called silent network authentication). If you choose to use it, you will be asked for your explicit consent before any check runs. As part of the check, your mobile carrier confirms — and in doing so shares — your phone number with StakeMarker over your cellular connection.
These checks run only if you choose the optional phone sign-in; signing in with another method avoids them entirely. When you do use it, and only with your explicit consent, the flow may also run two additional carrier-backed checks: a SIM-change (SIM-swap) check (whether the SIM behind your number changed recently) and an optional identity-match (KYC) check, which compares identity details you provide — your name, street address, postal code, date of birth, and email — against the records your carrier holds for that number. These checks are used only for security, fraud prevention, and identity verification.
- Storage and retention: if your phone number is shared through this flow, we store it with your account records. The identity details you provide for the optional match are used only to perform that check and are not retained by StakeMarker.
- Deletion on request: you may request deletion of your stored phone number and any related verification signals at any time by contacting support@stakemarker.com (or by deleting your account), and we will remove them.
- Sharing for matching only: for the identity-match check, the details you enter are shared with the carrier-verification service solely so it can compare them against your carrier's records and return whether they match; StakeMarker does not receive the carrier's underlying records.
- No third-party sharing: we do not sell your phone number or identity details, or share them with third parties, except the service providers required to operate the App — the managed cloud platform (Firebase) that hosts the App's backend, and the carrier-verification service that performs the phone, SIM-swap, and identity-match checks on our behalf. Each processes your information solely to provide that service.

Subscription Plans and Fair-Use Limits
Features labeled Included on the in-app paywall are available to subscribers of the listed tier without an explicit per-use price tag. To prevent abuse and protect shared infrastructure costs, the following per-account limits apply across all paid tiers:
- Live rounds created per month: up to 200 per account, calendar month, resetting at the start of each month (UTC).
- Saved rounds in the cloud: no fixed numeric cap, but storage is provided for normal personal use; bulk-creation, automated population, or sustained use beyond what a normal player could generate may be limited.
- Custom courses per account: up to 200 distinct custom courses regardless of tier (the per-tier cap on the paywall is a soft display limit; this is the absolute server cap).
- Courses played in your lifetime history: no fixed numeric cap for paid tiers; free accounts are limited to one (1).
- Scorecard scans per month: Plus 10, Pro 200, Ultra 500. Resets on the 1st of each month (UTC). Unused scans do not roll over.
- Voice commands: Ultra subscribers may issue up to 300 per day and 9,000 per month. Resets at midnight UTC daily and on the 1st monthly.
- Local round history (on your device): no fixed cap for paid tiers; free accounts retain the 10 most recent rounds on each device.
We may adjust these limits with notice via these Terms or the in-app paywall. Sustained use significantly beyond a typical individual player's pattern, automated/bot-driven activity, or use that materially degrades service for other users may result in additional limits, throttling, or account suspension under the Suspension and Termination section below.
Subscription billing — including pricing, renewal, refunds, taxes, family sharing, and cancellation — is handled by Apple's App Store or Google's Play Store, subject to their respective terms. We do not collect or store your payment card details. See our Privacy Policy for the data we do store when you subscribe.
Third-Party Services
The App may integrate third-party services, including Firebase and OpenGolfAPI. Your use of those services may also be subject to their separate terms and policies.
Intellectual Property
The App's code — including the HTML, CSS, JavaScript bundle, native iOS and Android shells, server-side Cloud Functions, and any compiled or transpiled output — is owned by or licensed to StakeMarker. You agree not to reproduce, redistribute, rehost, mirror, publish, sublicense, or commercially exploit the App's code, in whole or in part, on any other website, application, or service, except as expressly authorized in writing by StakeMarker. Inspection in a browser's developer tools for personal, non-commercial debugging is permitted; deriving a competing or substantially similar product from this code is not.
The course dataset displayed by the App is derived from OpenGolfAPI data, which StakeMarker mirrors under the Open Database License (ODbL) v1.0. The dataset is published separately at github.com/StakeMarker-LLC/stakemarker-courses and may be reused subject to the ODbL's attribution and share-alike requirements. Branding, App code, UI design, and any non-data intellectual property remain proprietary and are not covered by the ODbL.
All trademarks, brand names, logos, and graphics used within the App are owned by StakeMarker or their respective owners. Use without permission may infringe applicable intellectual property laws.
Disclaimer
Scores, handicaps, calculations, accounting information, and other data displayed by the App may contain inaccuracies, synchronization issues, display issues, or mathematical and calculation errors. The App is provided solely as a convenience tool, and you are responsible for independently verifying results before relying on them.
No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR THAT THE APP WILL OPERATE ERROR-FREE OR WITHOUT MATHEMATICAL OR CALCULATION ERRORS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAKEMARKER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSSES ARISING FROM USE OF THE APP, RELIANCE ON ITS RESULTS, OR ANY SCORING, HANDICAP, ACCOUNTING, MATHEMATICAL, OR CALCULATION ERRORS.
IN NO EVENT SHALL STAKEMARKER'S TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Indemnification
You agree to indemnify and hold harmless StakeMarker and its operators from claims, damages, liabilities, and expenses arising from your use of the App or violation of these Terms.
Suspension and Termination
StakeMarker may suspend or terminate access to the App at any time for violations of these Terms, legal compliance, or operational reasons.
Changes to Terms
We may update these Terms from time to time. Continued use of the App after updates are posted constitutes acceptance of the revised Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Washington, and you consent to the exclusive jurisdiction and venue of those courts.
Governing Language
These Terms and the Privacy Policy were drafted in English, and English is the governing language. We may provide translations of the App, these Terms, or the Privacy Policy for convenience only. In the event of any conflict or inconsistency between the English version and any translated version, the English version shall control.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
